Welcome to Holistic College Counseling (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Holistic College Counseling website, its services, and any consultations, packages, or resources provided by us. By using our website or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
1. Services
1.1 We provide college admissions and counseling guidance services, which may include free consultations, application support (Common App and supplemental essays), course selection guidance, leadership and extracurricular advising, teacher recommendation support, essay/interview coaching, assistance for student‐athletes, transfer students, international admissions, and more as detailed under our “Services” section.
1.2 We offer various packages (High School Package; Junior Year Package; Senior Rush; Student Athlete Package; Transfer Package; International Admissions; Ala Carte / hourly appointments) designed for different stages in a student’s journey.
2. Free Consultation
2.1 We may offer a free consultation, subject to availability. This consultation is provided in order to discuss your needs, understand how we may be able to assist you, and determine whether our services are right for you.
2.2 Completion of a free consultation does not obligate you to purchase any additional services. Any further engagement beyond the free consultation will be pursuant to separate agreement or contract.
3. Booking, Fees, Payment & Refunds
3.1 Booking: To utilize paid services, you may be required to schedule or book via our website or by contacting us directly.
3.2 Fees & Payment: All fees for packages or hourly appointments will be communicated prior to purchase. Payment terms (due date, acceptable payment methods, etc.) will be stated in the agreement or invoice you receive.
3.3 Refunds / Cancellations:

Cancellations or rescheduling of appointments must be done within a reasonable timeframe (which will be specified).

Non‐attendance without notice may still result in full or partial charges.

Refund policy for purchased packages or services will be outlined in the agreement; generally, once work has commenced (e.g. essays drafted, guidance given), fees may not fully refundable.
4. Client Responsibilities
4.1 You agree to provide accurate, complete, and current information for all processes (transcripts, activity lists, personal statements, etc.). Inaccurate or incomplete info may affect outcomes and our ability to deliver certain services.
4.2 You are responsible for meeting deadlines for any external application components (e.g. college deadlines, teacher recommendation deadlines). While we guide and support, final submission is your responsibility.
4.3 For international clients or those applying to U.S. institutions from abroad, you are responsible for immigration, visa, or other regulatory requirements beyond our guidance.
5. Intellectual Property
5.1 All content on the website (text, graphics, logos, images, videos, etc.) is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any materials on our site for commercial purposes without our prior written consent.
6. Privacy
6.1 We collect personal information (contact info, academic records, etc.) as required to provide our services. Use and protection of your personal data is governed by our Privacy Policy (linked from our website).
6.2 By using our services or submitting information, you consent to such collection, use, and disclosure as described in the Privacy Policy.
7. Disclaimer of Warranties; Limitation of Liability
7.1 No Guarantee: We endeavor to provide high‐quality services to guide you in the college admissions process. However, we cannot guarantee admission to any particular college or outcome. Success depends on many factors outside our control.
7.2 Disclaimer: Our services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non‐infringement.
7.3 Limitation of Liability: We will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services or your use of our website, even if we have been advised of the possibility of such damages. Our liability for any claim arising from or related to these Terms shall not exceed the amount you paid us for the specific service giving rise to the claim.
8. Termination
8.1 We may suspend or terminate your access to our website or services at our discretion, including if you violate these Terms.
8.2 Upon termination, any outstanding payment obligations survive.
9. Changes to Terms
9.1 We reserve the right to modify or replace these Terms at any time. If we make significant changes, we will post them on the website along with the new “Effective Date.”
9.2 Continued use after such changes constitutes your acceptance of the new Terms.
10. Miscellaneous
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts (or the state where the service provider is located), without regard to its conflict of law provisions.
10.2 Dispute Resolution: Any dispute arising out of or relating to these Terms or services shall be resolved first by good faith negotiation between the parties. If not resolved, then through mediation/arbitration (as applicable), or in courts of competent jurisdiction.
10.3 Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
10.4 Entire Agreement: These Terms, along with any separate written agreement (e.g. service agreement, invoice), constitute the entire agreement between you and us regarding use of the website and services, and supersede all prior or contemporaneous communications, proposals or agreements, whether oral or written.
